Is the U.S. a leader in international justice? There was a time …

“An American President always, always, always stands up for the freedom and justice of all people.” – Senator John McCain – August 29, 2012 – Republican National Convention - 13:00 minute mark of video
So, said John McCain in his speech at the GOP convention on August 29, 2012. Four years ago, John McCain was the Republican candidate for President of the United States. Would things have been different for Americans abroad if McCain had been elected? Would we have had FATCA? Would we have had an administration that would have deemed anybody with a non-U.S. bank account to be a tax cheat? Would US. citizens abroad, and US Green Card holders residing in the US, have been subjected to the FBAR Fundraiser? We don’t know for sure. Furthermore, we don’t know whether there would be a change in policy under a possible Romney administration.
International Justice, U.S. Citizens Abroad and the “Presidency” of Barack Obama:
The Oval Office has been occupied by a person who failed to stand up for freedom and justice for U.S. citizens abroad.
The Oval Office has been occupied by a person who have allowed the FBAR fundraiser to be used against U.S. immigrants.
The Oval Office have been occupied by a person who have allowed the IRS assault on U.S. citizens abroad.
We do know that Barack Obama and the Democrats have:
1. Been unwilling to stand up for freedom and justice for Americans abroad.
2. Been unwilling to engage in a meaningful dialogue on this issue.
It’s not Congress – It’s the administration
Some have suggested that the problem lies with Congress and that the administration can do nothing. This is a false statement. As McGill law professor Allison Christians has noted, some tax problems can be fixed by the US Treasury. Most of the problems of FBAR, FATCA can be solved by direct action by the Treasury Secretary. The infamous voluntary disclosure programs: “OVDP 2009″ , “OVDI 2011″ and “OVDP 2012″ are NOT Acts of Congress. They are programs invented by the IRS. On January 9, 2012 the IRS promised guidelines for U.S. citizens abroad who were trying to come into compliance. In June of 2012, the IRS stated that by September 1, 2012 the IRS would provide compliance guidelines for U.S. citizens abroad who had not filed tax returns. The guidelines for streamlined compliance were issued on August 31, 2012 and are not helpful to vast majority of U.S. citizens abroad. The IRS continues to be an obstacle, to U.S. citizens abroad, who wish to come into tax compliance. The new streamlined procedures for U.S. citizens residing outside the U.S. are not helpful. U.S. citizens abroad really do want to be tax compliant. They need to be told how to do this without facing bankrupting penalties. Time is running out. For many, renunciation of U.S. citizenship is the only option.
The IRS is under the direct supervision of the Secretary of the Treasury - Timothy Geithner. As legal scholars have noted, there are numerous other instances where the Treasury can act to mitigate the effects of some of the most damaging provisions of the IRC. It is important to recognize that the: design, use, resurrection and administration of various laws, have been under the control and initiative of the current administration!
Barack Obama and his administration have inflicted a grievous and unconscionable wrong on U.S. citizens abroad. Barack Obama and his administration have inflicted an unconscionable wrong on U.S. immigrants with Green Cards who are living in the Homeland. As unconscionable as his mistakes have been …
Everybody makes mistakes, the more important issue is how does one deal with the mistakes!
We have all been on the receiving end of bad customer service. We recognize that “bad customer service” is a reality of life. We are more likely to judge people NOT by whether they make mistakes, BUT BY how they deal with mistakes made. I have seen many instances of businesses gaining customers, gaining trust, gaining credibility and making friends by correcting mistakes. But, correcting mistakes requires:
- recognizing that a mistake has been made
- a willingness to enter into a dialogue to correct the mistake
- a willingness to correct the mistake.
Barack Obama and his administration have done none of these things. But, it is even worse.
Barack Obama and the Democrats are both:
- actively trying to avoid a discussion on the issues affecting U.S. citizens abroad; and
- actively trying to stifle discussion on the issues affecting U.S. citizens abroad
Barack Obama and his fellow Democrats can run but they can’t hide!
Professor Green, of Democrats Abroad (the overseas branch of the Democratic Party), suggests that the election is NOT the time to talk about issues affecting U.S. citizens abroad. It’s no wonder that Democrats Abroad and Americans Abroad for Obama (another invention by the Democratic Party) do NOT want dialogue with U.S. citizens abroad. h
An earlier post described how Americans Abroad For Obama had closed dialogue with U.S. citizens abroad. They are happy to broadcast to the world. They are NOT happy with U.S. citizens abroad broadcasting back to them. They appear to be shutting down any form of social media that invites dialogue. For example, once the Facebook dialogue started, Americans Abroad for Obama, promptly shut that Facebook page down. What about Democrats Abroad? On August 29, 2012 – for approximately 24 hours – Democrats Abroad made their Twitter site a private site. The effect was that one had to be approved to read their tweets, reply to their tweets or dialogue with them about the content of their tweets. In their attempt to curtail dialogue, they didn’t realize that they would no longer be able to broadcast to the public at large. As a result, they reversed their action and (at least of today) one can interact with Democrats Abroad on Twitter. I suggest that you do so.
Speaking of Social Media, A Possible Opportunity to Communicate With Barack Obama on Reddit
By creating Americans Abroad for Obama, the administration was (perhaps inadvertently) opening dialogue with U.S. citizens abroad. By closing down the interactive component of Americans Abroad for Obama, the administration was closing dialogue with U.S. citizens abroad.
On August 29, 2012 the day that John McCain was speaking at the Republican Convention and the day that Democrats Abroad were taking their Twitter account private, Barack Obama was answering questions on Reddit.com – a new kind of social media. This was very interesting because it featured live interaction with certain Americans. Might this be a way to communicate directly with him? Those interested will find the Barack Obama Reddit account (for lack of a better word) here. Those patient enough and clever enough may be able to find a way to question Barack Obama directly! If an unemployed law school graduate can talk to Mr. Obama on Reddit, then maybe a a U.S. citizen abroad can talk to Barack Obama.
“An American President always, always, always stands up for the freedom and justice of all people.” – Senator John McCain
It’s clear that Barack Obama has no interest in standing up for the freedom and justice for U.S. citizens abroad.
Either Barack Obama is NOT an American President or U.S. persons abroad are NOT people.
The fact that U.S. citizens are required to file tax returns and FBARs is “proof positive” that they are people.
It therefore follows that: Barack Obama is NOT an American President.
November 6, 2012 would be a good day to remind him of this.
